01. Acceptance of Terms

By executing an engagement letter, work order, or formally proceeding with professional services provided by AssuredFix (“Consultancy”), the Client agrees to be bound by these Terms and Conditions. These terms constitute a legally binding agreement for engineering consultancy, structural diagnostics, and waterproofing auditing services.

02. Scope of Services

AssuredFix provides specialized engineering consultancy focused on structural waterproofing integrity. The specific scope of work—including diagnostics, forensic audits, site inspections, and technical advisory—shall be detailed in a separate Statement of Work (SOW) or Engagement Letter.

Our services do not include physical construction, general contracting, or direct application of waterproofing materials unless explicitly stated. Recommendations provided are based on forensic analysis and industry best practices at the time of assessment.

03. Intellectual Property

All diagnostic methodologies, proprietary assessment tools, forensic reports, designs, and technical documentation produced by AssuredFix remain the exclusive intellectual property of the Consultancy.

Upon full payment of fees, the Client is granted a non-exclusive, non-transferable license to use the final reports solely for the internal remediation, structural maintenance, or legal requirements related specifically to the assessed property. Reports may not be published, sold, or distributed to third-party competitors without written consent.

04. Data Security

To ensure accurate diagnostics, the Client agrees to:

  • Provide safe, unrestricted access to the site during scheduled inspection times.
  • Supply all available historical structural data, previous architectural plans, and records of prior remediation attempts.
  • Ensure site conditions are prepared as requested prior to advanced forensic testing (e.g., thermal imaging or moisture mapping).

Failure to provide necessary access or accurate historical data may result in incomplete diagnostics, for which AssuredFix bears no liability.

05. Limitation of Liability

AssuredFix conducts diagnostics utilizing current engineering standards and advanced forensic technology. However, structural conditions can change rapidly due to environmental factors.

The total liability of AssuredFix, its engineers, and agents, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by the Client for the specific engagement giving rise to the claim. AssuredFix shall not be liable for any indirect, consequential, or punitive damages, including loss of use or revenue.

06. Termination

Either party may terminate the engagement with written notice if the other party materially breaches these terms and fails to cure the breach within 14 days. Upon termination, the Client is responsible for payment of all services rendered and expenses incurred up to the date of termination.

07. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which AssuredFix is headquartered, without regard to its conflict of law principles. Any disputes shall be resolved in the competent courts of that jurisdiction.
